Traditionally, the study of public international law has mainly focused on legal norms established by various States, such as treaty and customary international law. However, recently, private standards have begun to draw academic attention. This is because the scope of international law has expanded to the rules for protecting the interest of the international community as a whole, such as the protection of human rights and the environment. When establishing these rules, the bottom-up approach (private standards) is sometimes more appropriate than the top-down approach (treaties). Therefore, private standards are particularly relevant in the context of international environmental law and human rights law.
On the other hand, however, the relationship between private standards and the law of the sea has not been analyzed from the perspective of public international law. If there are no private standards related to the law of the sea, the lack of such analysis seems inevitable. However, some private standards, including the standards set by the International Organization for Standardization, works for ocean governance. Therefore, this research aims to study how private standards work and should work in the future, in the context of the international law of the sea.
